Day one: An ax murderer gets swift justice

Francisco Torres

1892: Mexican laborer Francisco Torres did not like it much when William McKelvey, his boss at the Orange County ranch owned by famous Polish actress Helena Modjeska, docked his pay to cover an unpaid tax.

The dispute led to an argument that escalated into a murderous beating with a pick ax. Torres immediately fled from the scene but was captured days later in San Diego County. He insisted that he acted in self-defense.

Anti-Torres sentiment was so high in Orange County after a preliminary hearing that Torres’ defense lawyer said he would ask for a change of venue. His “trial” was short and swift: vigilantes broke into Torres’ jail cell, dragged him outside and hanged him from a lamp post. A sign that read “a change of venue” was pinned to his chest, according to a report in the Los Angeles Times.

          Day laborer is not necessarily the same as undocumented. Sure its likely that many of them are, but there may be others who have papers, and especially in this economy that are trying to get any kind of work they can.

          BTW, it identifies Torres as Mexican. It does not say he was here illegally. He may very well have been here legally.

          Also the article does not say how they know what happened, like if there were reliable witnesses or what.

          day laborer, i’ve known people who are born US citizens picking up jobs as Day Laborers. so you have no basis of caiming ‘day laborer’ is the same as illegal undocumented. and also have you ever taken history at one time california was part of Mexico if you have forgotten, anyone in the country who is a legal documented worker is the same.

He just worked here, that was it. No one was worrying about legal status or saying he was an illegal immigrant. He just worked, thats it.       Justice? Taking people out and hanging them without trial is justice?

      While they may overdo all the protections for the accused these days, not all of them are guilty. Even those in gangs accused of murder could be innocent–it could have been someone else.

      Sure shooting women and children or anyone is not acceptable, but we need to make sure that we get the right person for any crimes committed–not just someone who looks like they are guilty.

        Not sure you where you get your idea of the word laborer, but it has nothing to do with legal status. It means worker. It is a job title in construction–an entry level one. They have laborers, carpenters, plumbers, electricians, etc.

        Being described as a laborer would likely mean that he did the grunt work around the place.

      This article is not about immigration, legal or illegal. Things were much different back then. He is described as Mexican but it is my impression that some who were called that back then may have been of Mexican decent but may have been Californios–those who were here first.

      We really don’t know much about his status or even what evidence there was against him. So lets not project current conflicts back to something that happened over 100 years ago.

    The most evident fact of nature is that it is survival of the fittest. Being human makes us no different. The US won the war for this land and we as its citizens reap the benefits of that. It all happened in a much different era and I don’t think anyone is deserving of an apology for how it was done. Don’t get bitter, get better.

    Anyone can be successful in this country today. Even illegal aliens breaking our entry laws can become something. I don’t think that makes it right but until the flow of law breakers crossing all our borders is stopped, the tax payers will be footing the bill.

    I know that none of us would want CA or any state of the southwest to part or be returned to Mexico. Mexico is a corrupt country. I wouldn’t want to live anywhere else. However, somebody made an ignorant comment about “If Mexico didn’t want to lose the Southwest, it shouldn’t have picked a fight in 1845…” First of all, read your history buddy if you’re going to make silly statements like that. Mexico did not pick a fight. Americans were allowed to immigrate to Texas by the Mexican government on the condition that they wouldn’t practice slavery which was illegal in Mexico at that time. Of course, Sam Houston and his buddies didn’t like that and defied the Mex govt and continued the slave trade in Texas. Mexico sent armed forces to enforce the law which was the abolishment of slavery. As a U.S. citizen Houston called on the American government for help. Which of course came to his aid because they saw it as a perfect opportunity to fulfill manifest destiny (the occupation of the southwest to the pacific ocean). Now if you know your true “American” history, there was a tons of malicious practices that contributed to the growth of the country which we now know and love. It’s important to know your history so it will not repeat again. Guys like Marley and Thomas are ignorant. It’s obvious. They blame everything on “illegals”.

      You’re confusing the Texas Revolution of 1836 (Sam Houston, the Alamo, etc.) with the Mexican-American War of 1845-1848. In which yes, the Mexican army fired the first shots, at La Rosia, ambushing an American patrol on the land between the Nueces and Rio Grande rivers which was claimed by both Mexico and the U.S., which had just annexed Texas.

      Now, if my grasp of history were so public-school tenuous that I’d make that kind of mistake, I’d be a little more careful about calling people “ignorant.”
